This is understandable, since all of us like to feel we have a good working relationship with our bosses, and none of us would willing to damage that if it can be helped at all.</p>
<p>But actually, there is little reason to fear damaging a good relationship with either your colleagues or superiors by making a personal injury claim, and even less reason to think making one should result in the loss of your job.</p>
<p>There&#8217;s a large number of situations that may prompt an employee to make an accident at work claim, though they can depend greatly on the industry sector in question. From a simple slip and fall that leaves an ankle broken, to faulty machinery that causes a limb to be severed, the risks in any workplace are numerous.</p>
<blockquote><p>Regardless of the type of accident that an employee might have at work, there is no reason to be hesitant in making a claim. In fact, here are three reasons why.</p></blockquote>

<h2>The Law Allows It</h2>
<p>The main reason not to be nervous making a claim against an employer  is that the law permits and protects the claimant. Once an incident can be proven to have caused injury and was due to the negligence of the employer, the law states that the injured employee is eligible to make a claim.</p>
<p>Of course, it is only natural that the employer will not welcome such a development with open arms, but regardless of whether a claim is successful, the employer isn&#8217;t allowed to dismiss the claimant. In fact, he is not permitted to alter the terms of employment, number of working hours or in any way punish an employee for making a claim. That means that once the outcome of a claim is decided, there is absolutely no victimisation permitted, in any way.</p>
<p>The fact is that victimisation very rarely occurs in any case. This is generally because the matter is dealt with between lawyers and insurance representatives, allowing employee and employer time to continue things.</p>
<p>Having said that, claims that are proven to be frivolous can sometimes provide an employer with grounds to dismiss, though it is essential to note that just because a claim is unsuccessful does not mean it was frivolous.</p>

<p>The everyday fear, particularly amongst people who work for small companies, is that the result of making a claim would be to seriously damage the financial position of the company. More often than not, the employer is actually very sympathetic and supportive, and often offer to pay for any medical expenses incurred.</p>

The only consequences that an employer will suffer is the expense of putting in place improved safety measures, and possibly an increased insurance premium.</p>

<p>If a claimant already has a good relationship with an employer, it is highly probable that there could be agreement between both parties in the first place.       <p><strong>Compensation Claims Companies making unsolicited phone calls to private residences or mobiles asking if the recipient would like to file an accident compensation claim are in violation of laws regulating the claims industry and should be reported to the Ministry of Justice, say the personal injury solicitors at Claims Review in Grimsby.</strong></p>
<p>Chris Leadley, Manager of Claims Review, said that he has received such calls himself despite not even being in an accident,</p>
<blockquote><p>&#8220;On answering the call, there was an automated message referring to a recent accident and saying that an adviser was on hand to talk to me and secure several thousands of pounds in compensation for me.&#8221;</p></blockquote>
<p>According to Mr Leadley, the Ministry of Justice regulates claims companies to ensure that they do not make unsolicited contact with potential claimants. His advice to anybody who has been interrupted or annoyed by similar phone calls is &#8220;do your best to get the name of the company or a contact number so you can file a complaint with the Claims Regulation Unit at the Ministry of Justice as soon as possible.</p>
<blockquote><p>&#8220;This type of lead generation marketing is against the law for a reason &#8211; it is intrusive to members of the public and it encourages scurrilous types of claims that have given accident compensation claims solicitors a bad reputation. This type of aggressive marketing just belittles those people who have suffered a genuine injury and harms their ability to get their claims heard by the courts quickly. It is an aggressive and very unwelcome form marketing, and presents the wrong image of the legal profession.&#8221;</p></blockquote>
<p>He also explains that texts sent to peoples phones with a similar purpose are also in violation on the law and should be reported in the same way.</p>

<p>The Law Society sent a letter of claim to the owner of the Solicitors from Hell website last week, as it prepared to launch a class action against him on behalf of the profession.
<p>The letter demands that website owner Rick Kordowski must close the site, or face an action for defamation, harassment and breach of the Data Protection Act.
<p>More than 300 individual solicitors, law firms and others have joined the action against Kordowski, having been affected by the site. The <a href="http://www.lawgazette.co.uk/news/solicitors-hell-face-legal-action">action</a> is also being brought on behalf of the profession as a whole.
<p>The letter of claim, sent by the Society’s solicitors Brett Wilson, points out that Kordowski has been sued for libel on at least 16 occasions in relation to the website.
<p>It notes that more than £150,000 has been awarded against him in damages, which remains unpaid.
<p>Brett Wilson said its analysis of the 990 postings on the site between 15 April and 10 August 2011 indicated that the site serves ‘no legitimate purpose’.
<p>It said the site was a ‘magnet for the vexatious and bitter whose complaints would not stand up to scrutiny in any impartial tribunal or forum’. In many cases the author is a disgruntled opponent, the firm said.
<p>The Society’s letter of claim sets out a schedule of undertakings on which it seeks agreement from Kordowski. These include an undertaking to remove the entire site from the web and not to publish any of the content in future, or set up any other website with a similar name.
<p>A Law Society spokeswoman said: ‘Not all solicitors defamed on the website can afford the time and trouble to bring a case themselves, and the Law Society is taking every possible step to protect our members and the public interest.’
<p>Kordowski said he denied all the allegations made against him. He pointed to the high levels of complaints against solicitors received by the Legal Ombudsman, and said the Society had rejected his offer to work together to expose wrongdoing in the profession.
<p>In a separate development last week, Kordowski lost two applications to appeal earlier judgments against him won by Megan Phillips, solicitor at London firm Bhatt Murphy, and Juliet Farrall, solicitor at London firm McCormacks.
<p>In Farrall’s case, Sir Richard Buxton held that Kordowski’s ‘argument that he offered the claimant the alternatives of excusing herself to him or paying a substantial amount of money, in each case to secure the removal of the posting, casts a dire light on the way in which he conducts his business’.
<p>He added: ‘The need to control the applicant’s activities’ had made ‘considerable demands on the court’s time&#8217;.

      <p><a href="http://www.bolton.gov.uk">Bolton Council</a> paid out more than £400,000 in injury compensation claims last year, The Bolton News can reveal.</p>
<p>The payouts, uncovered following a Freedom of Information request, are made up of a string of claims made by members of the public amounting to £360,000 as well as £50,000 compensation awarded to council staff.</p>
<p><strong></strong>
<p>The council made 71 payouts to Bolton residents, ranging from £850 to £27,000, for slips, trips and falls on council footpaths and pavements. One of the payments was for an accident involving a child.</p>
<p>There were a further 15 payments made to council employees, including teachers and school staff, ranging from £1,000 to £13,750.</p>
<p>Accidents included a fall from a chair, slipping on polythene wrapping, a trip on a pothole and someone who tripped over a picnic table. One woman worker received £13,750 for a fall in a car park while another member of staff was awarded £4,500 after injuring his back while caring for someone.</p>
<p>The previous year, almost £600,000 in compensation was paid out to people who tripped and fell on pavements, but this was a reduction of more than £200,000 for 2008/09, when <a href="http://www.thisislancashire.co.uk/search/?search=Bolton+Council">Bolton Council</a> paid out £804,124.</p>
<p>The council says it does not pay out on 75 per cent of claims it receives.</p>
<p>The council stated it paid out early on claims where it believes it is responsible to avoid costly legal battles.</p>
<p>A spokesman added: “If we think the case is defendable then we will not pay out and contest the claim in court.”</p>
<p>Nearly £2 million is currently being invested in the borough’s road network, but the council said the claims relating to potholes were not a significant proportion.</p>
<p>The TaxPayers’ Alliance blamed a growing “compensation culture” in the UK.</p>
<p>Research director John O’Connell said: “Taxpayers will be shocked to hear what huge sums are being paid out. Sadly there is a growing compensation culture and while some claims are unavoidable, it’s disappointing that big payments are often made for seemingly little more than everyday accidents, wasting taxpayers’ cash and making council staff paranoid about carrying out their <a href="http://www.theboltonnews.co.uk/jobs">jobs</a>.”</p>
<p>Personal injury specialist Michael Hardacre, Partner at Manchester law firm Pannone, said there is no such thing as a compensation culture.</p>
<p>He said: “Try telling the widow of someone who has just died from asbestos related cancer that she is a greedy compensation seeker because she is looking for justice for her husband.</p>
<p>“Even on a less dramatic scale, the principles remain the same for someone who slips and injures themselves on a pavement that has not been properly maintained by a council.</p>
<p>“They should also be able to seek recompense from that council for their injuries and very often loss of earnings.</p>
<p>“Over the last few years, many councils have improved their standards enormously and have as a result reduced the amount they pay out in compensation.</p>
<p>Some councils simply take the view that it’s easier to pay out compensation than to spend the money improving standards.</p>
<p>Ultimately the point of claimants having the right to sue, is to hold the failing councils to account and make them do the simple things we pay our council tax for, like filling potholes in the road, more quickly and properly.”</p>
